What are arbitration, mediation, and civil and commercial litigation?

Civil and commercial litigation, along with alternative dispute resolution methods such as arbitration and mediation, are important aspects of the legal system.

According to our statistics, in the Dominican Republic, 75% of legal problems that arise within a company occur due to a lack of or poor prevention strategy that ensures each step the company takes in any direction will not create an adverse legal effect, and therefore the consequences will be more beneficial than harmful.

  • Commercial litigation relates to disputes between businesses, including issues of contractual disputes, intellectual property, unfair competition, etc.
  • These disputes are generally resolved through the ordinary courts of the Dominican judicial system. The process may vary depending on the complexity of the case and the jurisdiction in which it is presented.

Arbitration

  • Arbitration is an alternative dispute resolution method where the involved parties agree to submit their dispute to an arbitrator or a panel of arbitrators instead of going to court.
  • In the Dominican Republic, the Commercial Arbitration Law No. 489-08 regulates both international and national commercial arbitration. This law aligns with the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
  • Parties may agree on the arbitration process, including the choice of arbitrators, the venue, the language of the arbitration, as well as the applicable rules. The decisions of the arbitrator are binding on the parties and are generally not subject to appeal, except under very limited circumstances.

Mediation

  • Mediation is a process in which a neutral third party, the mediator, helps the conflicting parties reach a mutually acceptable agreement.
  • While mediation is not as formal as arbitration or litigation, it can be an effective tool for resolving disputes quickly and economically.
  • In the Dominican Republic, mediation can be voluntary or ordered by a court. The Law of Mediation and Alternative Methods of Conflict Resolution No. 69-00 provides the legal framework for mediation in the country.
